About Micro Wholefoods

These terms apply to purchases from and use of the Micro Wholefoods website. The business is operated by Michael Yates trading as Micro Wholefoods, ABN 15 645 746 159.

Contact microwholefoods@gmail.com or +61 406 316 456. Our business and pickup address is 503/9 Williamsons Road, Doncaster VIC 3108, Australia.

Orders and availability

Please check your selected product, size, quantity, delivery address and contact details before placing an order. You must be authorised to use the payment method supplied.

We will communicate acceptance or any issue affecting your order. If goods are unavailable or we cannot lawfully or reasonably fulfil an order, we will contact you and arrange an agreed alternative or refund any amount paid for goods we cannot supply; we will not substitute a different product or charge a higher price without your agreement.

We may decline an order on reasonable grounds, such as genuine availability, payment, fraud or legal restrictions. An accepted order will not be cancelled merely because we later change our prices; any cancellation must be consistent with the agreement and applicable law.

Prices, currency and payment

Prices are in Australian dollars unless another currency is expressly displayed. Product prices, applicable shipping charges and any other disclosed charges are shown before you complete checkout.

Micro Wholefoods is not currently registered for Australian GST and does not add Australian GST to its prices. We do not deduct 1/11 from international orders as an Australian GST refund; any future change to tax treatment will be reflected accurately in checkout and the applicable terms.

Payment is due at checkout unless we have expressly agreed different written wholesale payment terms. Payment processing is subject to the providerโ€™s applicable terms and any required verification.

If there is a genuine pricing or listing error affecting your order, we will contact you to resolve it. You will not be required to accept an increased price, and any cancellation or refund will comply with applicable law.

Delivery and pickup

Our published shipping policy describes available delivery methods, charges, dispatch arrangements and pickup instructions. Delivery estimates are not guarantees unless we expressly agree a guaranteed service.

Please supply accurate delivery details and contact us promptly if they need correction. We will discuss any appropriate redelivery arrangement before charging an additional fee; a carrier delay or lost parcel does not automatically remove your consumer rights.

For pickup, wait until we confirm your order is ready. The pickup address is not automatically the return address, so contact us before returning goods.

For supported international orders, destination duties, taxes and import requirements may apply as explained in our shipping policy and checkout. We do not currently ship to the United States or Canada.

Cancellations, returns and refunds

Contact us promptly if you wish to change or cancel an order. We will assist where reasonably possible before dispatch, but cannot promise a change once fulfilment or dispatch has occurred; this does not affect mandatory cancellation rights.

Our refund policy explains voluntary change-of-mind conditions and your separate statutory remedies. No policy condition limits rights that cannot be excluded under the Australian Consumer Law or other applicable mandatory law.

If we agree a cancellation or owe you a refund, we will explain the process and refund the amount due in accordance with that policy and the law. You do not have to accept store credit instead of a statutory refund.

Food products and information

Read the product label, ingredients, serving directions, storage instructions and best-before information before use. Seek appropriate professional advice if you have a medical condition, take medication, are pregnant or breastfeeding, or are unsure whether a product is suitable for you.

Our food products and website content are not a substitute for medical advice and are not represented as diagnosing, treating, curing or preventing disease. General product information and customer reviews do not guarantee an individual result, and this section does not limit responsibility for misleading descriptions, unsafe goods or other statutory failures.

Retail and wholesale purchases

We accept retail purchases and approved wholesale orders. Any specifically agreed written wholesale prices, minimums, payment and freight arrangements apply to those orders alongside these terms.

Wholesale purchasing is not prohibited by a personal-use-only website condition. Nothing in a wholesale arrangement excludes consumer guarantees where they apply.

Website use and intellectual property

You may use the website to browse, obtain information, purchase products and conduct approved wholesale dealings. Do not misuse accounts, attempt unauthorised access, introduce malicious code, commit fraud or interfere with the website or other customers.

Website content and brand material remain the property of their respective owners. Using the website to purchase products does not give permission to copy or commercially exploit protected content without permission, except as allowed by law.

Consumer rights and liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies a right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified.

Changes, applicable law and disputes

Changes to these terms apply prospectively and do not retrospectively change an accepted order without your agreement or a lawful basis. Any specifically agreed order terms remain subject to mandatory law.

Victorian and Australian law apply, subject to any mandatory consumer law or right to bring a claim in another jurisdiction that applies to you. If a problem arises, contact microwholefoods@gmail.com so we can try to resolve it; this does not prevent you from seeking assistance or exercising a legal remedy.
